foreclosure wipes out lis pendens?

"A foreclosure will wipe out a lis pendens, unless the mortgage or other lien which is being foreclosed was created after the suit was filed." Are you sure about this? I thought a lis pendens stayed because the subsequent buyer at the foreclosure sale had constructive notice. --98.210.115.1 (talk) 00:35, 8 January 2009 (UTC)[reply]

When the lawsuit concludes with a foreclosure the lis pendens ends. If the foreclosure does not go through, then yes it continues with the buyers constructive notice. —Preceding unsigned comment added by Lispendens85 (talkcontribs) 12:27, 5 June 2009 (UTC)[reply]

In any case, the statement is untrue of any lis pendens except one that is about the foreclosure. And no recording ever gets wiped out or ends automatically -- someone has to tell the recorder to do it. So I deleted this paragraph because it's just too vague. Completely different meanings

If I am understanding correctly, the meaning of lis pendens in English, and the corresponding French Wikipedia article which is linked here (Litispendance) are totally different meanings. Article would benefit from section concerning implications of improper filing of lis pendens

I think it would improve the article to include a section on the implication of an improper lis pendens filing, which may subject a party to liability for slander of title. I may do this when I have some more time. Jameson Nightowl (talk) 04:16, 22 April 2024 (UTC)[reply]
